Housing Controls for the Peninsula

Mornington Peninsula Shire started a planning scheme amendment (Amendment C219) to update the planning controls and residential zones in 2018. This amendment has just made its way to the final stage in the process, having now been adopted by the Council and submitted to the Minister. Once the Minister approves the amendment (which will likely take months) it will be gazetted and implemented into the planning scheme.

The shire has started to inform applicants of new planning applications that they must take the amendment into account and that variations from the new proposed planning controls may not be supported. Until the Minister approves the amendment the changes won’t be part of the planning scheme, however as it is in this final stage it is deemed “seriously entertained” and so decisions will start getting made with the planning control changes in mind. Because of this, while the controls haven’t yet been introduced it is important to review the proposed amendments as part of any new planning application now.

Some of the changes implemented with the amendment include changes to building heights as well as new siting and setback requirements for new developments. One positive for some land owners is that the planning controls for single dwellings have been simplified and more applications won’t need a planning permit in the future.
